The Dartbrook Coal Mine at Aberdeen has been given a five year lifeline, after years of legal struggles.
The NSW Land and Environment Court has upheld an appeal by Australian Pacific Coal to continue operations until 2027.
The company were allowed to re-open the controversial site in 2019, but the Independent Planning Commission told them then, only until 2022.
The mine was originally closed in 2006, after a number of safety issues, including the deaths of three people.
