University of Newcastle Survivors Take a Stand Against Violence

BY OLIVIA DILLON

A University of Newcastle student has founded the institution's first survivor-run advisory advocates group.

21 year-old Sarah Williams is a child sexual abuse and adult sexual assault survivor, third-year law and communications student, and an advocate for survivors across the region and country.

She previously founded What Were You Wearing, an education, awareness and advocacy organisation run by sexual violence survivors.

Ms Williams said the Survivors Advocates Advisory Board will provide a diverse insight into the lived experience of the survivor.

"I only want the group to go ahead if it has First Nations people on it, people living with disabilities, and LGBTQI+ identifying people, because as we know from statistics, those three groups are disproportionally affected by sexual violence, and particularly sexual violence on campus," Ms Williams said.

The group of 10 student survivors will meet once a month to discuss how to support victims and combat violence on campus.

They will be joined by a trauma-informed psychologist at meetings to provide support on potentially triggering issues, and are assured the group will be a safe and confidential space.

The establishment of the group comes after the latest National Student Safety Survey revealed almost one in five UON students had been sexually harassed since starting their studies.

It also aligns with the Federal Government's announcement today, it will launch the National Plan to End Violence Against Women and Children.

The 10-year plan is underpinned by six principles, one of which involves working with victim-survivors to develop policies and solutions.

Ms Williams said she's excited to see higher-ups working with survivors to find solutions, and she already has suggestions for the University to implement.

"Being able to have that voice is really powerful. You feel like you're able to assist in making change. It also makes you believe that the government actually does want to make change and they don't want to continue to see the statistics that we continue seeing, which is really great," she said.

"I'd love to see more consent education brought out in the University to regular students, rather than just student residents. Currently you do a consent module, but that's just once when you do your degree and it's nothing at all; it's very outdated in our opinion."

Applications to become one of the 10 survivor advocates are open to anyone who will be studying at the University in 2023 (including current Year 12 students) and will close on the 24th of October.

More information can be found on the What Were You Wearing website.

Calls for action as sexual assault rates surge in the Hunter

BY DAKOTA TAIT

The State Government is facing calls to take action, as rates of sexual assault and domestic violence climb in the Hunter.

According to the latest Bureau of Crime Statistics and Research figures, the Hunter Valley's seen a 39.8 percent increase in sexual assault incidence over the past five years, the highest in New South Wales.

The Newcastle and Lake Macquarie area saw an 11.3 percent rise.

Across the state, sexual assault rates rose by 14.3 percent, and domestic violence by 10.6 percent.

Charlestown MP and Shadow Minister for the Prevention of Domestic Violence and Sexual Assault Jodie Harrison says the figures are deeply concerning.

She's calling on the NSW Government to put more money into the Sexual Violence Helpline, following revelations earlier this year, one in three calls to the service wasn't being answered.

Women's advocates welcome affirmative consent laws in the Hunter

BY DAKOTA TAIT

New laws are now in force across the Hunter and the State, meaning people now need to give and receive clear consent from both parties before having sex or engaging in any sexual encounter.

It's hoped the reform will set clearer boundaries in situations where people are coerced or forced, or are in an unconscious state such as being asleep or intoxicated.

Nova for Women and Children CEO Kelly Hansen is welcoming the legislation.

She says it's a huge step in the right direction.

"I think that it has the ability to change attitudes around this, particularly with who they're targeting," she said.

"16 to 24-year-olds through social media, so really educating youth, and also, interestingly enough, they're targeting people through Tinder, older people."

Under the new laws, consent needs to be given freely and voluntarily, and can be withdrawn at any time.

Likewise, consent needs to be present for every sexual act, and consent in one given case doesn't apply to others.

There's an emphasis on communication, with both parties needing to do or say something to show or seek clear consent.

The State Government has worked with the legal system to make sure judicial officers, police, prosecutors and defence lawyers are up to speed on the changes.

It's hoped the legislation won't only better hold perpetrators to account, but curb rates of sexual assault.

Ms Hansen says victims can often feel ashamed about what happened.

She's hoping the laws will also trigger a cultural shift for both perpetrators and victims of sexual violence.

"Often telling your story, you'll often avoid telling it," she said. "Particularly if you feel like you gave consent to begin with, and then pulled out and it still happened."

"It's changing those attitudes and seeing that you have a right around your body."

The laws come alongside a package of new directions judges can provide to juries, which are hoped to ease the burden on the prosecution and victims of sexual violence.

The directions include a number of clarifications, including that rape can still occur in a relationship or that sexual offences aren't always accompanied by violence or coercion.

Juries also must not rely on preconceptions around how victims react to trauma or emotional distress in court, or make assumptions that someone consented because they were under the influence of drugs or alcohol.

"I'd read an article from the UK that talked about rape within marriage," Ms Hansen said.

"Often, juries have older people because they've got time to be on a jury and do jury duty, and often there would not be a conviction. They doubted rape within marriage."

"For me, the most exciting part is that direction to juries, and really challenging some very old attitudes and very patriarchal attitudes toward women."

Calls to Introduce Consent Classes in Hunter High Schools

BY DAKOTA TAIT

The NSW Government is facing calls to put forward $250,000 in funding toward an early intervention program discussing consent and healthy relationships in high schools across the Hunter and the State.

The issue was raised at a NSW Budget Estimates inquiry on Tuesday following reports of alarming rates of sexual assaults of students in Sydney.

Love Bites, a respectful relationships program offered by the National Association for the Prevention of Child Abuse and Neglect, requested the funding to help train more facilitators and expand efforts following increased demand from Sydney high schools.

Labor MP Trish Doyle, Shadow Minister for the Prevention of Domestic Violence, said communities should not have to resort to fundraising to help get these services off the ground.

"It's important that governments not only provide services to those issues, but that they also invest in primary prevention," Ms Doyle said.

"Let's pump some money into our schools, let's have our young people change this culture of violence and discuss what a healthy relationship looks like and what to do if you're in one that's not."

19-Year-Old Charged Over Alleged Sexual Assault of Girl At Wallsend Park, Posting Recordings to Social Media

BY ISABEL EVERETT

A 19-year-old Cardiff man has been charged over the alleged sexual assault of a young girl he met on social media.

Last month, detectives commenced an investigation, following reports a 12-year-old girl had allegedly been sexually assaulted by the man at a park in West Wallsend in April this year.

It is also alleged the man shared recordings of the incident on social media.

Following extensive inquiries, investigators executed a search warrant at a home at Cardiff about 8.40am on Tuesday August 4th.

During the search, officers seized mobile phones and other electronic devices.

The 19-year-old was arrested and taken to Toronto Police Station, where he was charged with intentionally sexually touch child (between 10 and 16 years), five counts of have sexual intercourse with child (between 10 and 14 years), produce child abuse material and disseminate child abuse material.

He was refused bail to appear at Toronto Local Court on Wednesday 5 August 2020.

Child Abuse and Sex Crimes Squad Commander, Detective Superintendent John Kerlatec, said the incident is a timely reminder for parents and carers to speak with young people about potential dangers online.

“While social media apps allow us to be better connected with people we know, they also provide opportunity for people we don’t know to connect with us – and this includes strangers talking to our children,” Det Supt Kerlatec said.

“For young people, any online platform that allows them to be in contact with people they do not know – and have only met in the online environment – can put them at risk.

“We know that sexual predators may use the online environment to target children, so it is imperative that all young people know what to do if they are exposed to explicit or inappropriate conversations.

“It is common for young people to feel uncomfortable reporting these types of conversations, so I urge parents and carers to make sure they’re assured that they don’t need to be embarrassed or upset.

“From a police perspective our priority is protecting children from any type of harm, and we will track down anyone who uses the internet to groom and/or procure children for sex.

“Finally, I want to remind everyone to be careful about providing personal details on social media, especially to someone they only know online, and take extreme caution if making plans to meet up – consider whether you really know who it is you are meeting,” Det Supt Kerlatec said.

Hunter Sexual Abuse Survivor says New Reforms Should Lead to More Convictions

BY ISABEL EVERETT

Hunter survivor of child sexual abuse, Peter Gogarty, has welcomed reforms introduced to State Parliament today which will allow jurors to be told about an accused abusers prior convictions.

The changes in legislation are expected to remove a significant barrier preventing child sex offenders from being held to account and leading to ‘unwarranted acquittals’.

University of Newcastle Criminologist, Peter Gogarty, suffered sexual abuse as a child from a member of the Catholic Church and says these reforms should dramatically increase convictions in the cases of other survivors.

"These sorts of crimes happen very much in private so it becomes an I said, he said sort of scenario which has always worked to the benefit of the perpetrator," he said.

"So now we have the potential for other victims of that same person to have their evidence heard in court. The value of that in terms of proving the behavior of a pedophile will have a dramatic improvement in having convictions of these people."

A Royal Commission into Institutional Responses to Child Sexual Abuse heard about many criminal proceedings in which evidence of an accused person previously offending against children was ruled inadmissible due to courts’concerns that it may unfairly prejudice the accused person.

Mr Gogarty said the removal of these proceedings would have allowed him to provide evidence on his own abuser, which would have assisted in his conviction.

"In my own case, I was prepared to give evidence against Father James Fletcher in somebody else's matter. The judge at the time thought my tendency evidence didn't have sufficient value under the legislation as it then existed," he said.

"If that exact same case was to happen today, my evidence would have been admitted, the jury would hear that and I think that would result in more convictions and probably stronger sentences."

NSW is the first Australian jurisdiction to introduce agreed legislation enabling greater admissibility of tendency and coincidence evidence, such as evidence about an accused person’s tendency to have a sexual interest in children.

"The NSW Attorney General, Mark Speakmen has been pushing other States to follow suit. I'm confident that they will do that," Mr Gogarty said.

Mr Gogarty says the reform is an amazing step forward, however there are still significant changes which need to be made.

"I think the other big issue that remains is the protection that is still afforded to the seal of the Confessional in the Catholic Church."

"I know that the Attorney General is looking at that. I think they need to be bold and brave and say that protection no longer exists in the confessional when someone confesses to a child sexual assault."

Valentine Man Accused of Grooming, Sex with Minor

BY LAUREN FREEMANTLE

Police are reminding parents to monitor their children's internet habits, following the arrest of a Hunter man for child grooming.

Detectives from the Child Abuse and Sex Crimes Squad launched investigations late last month after reports surfaced a 15-year-old girl had been sexually assaulted by a man she met on social media, who claimed to be 17.

The man later claimed he was aged 27, and the pair met in the Newcastle area on Saturday 29 September where they allegedly had sex.

The 35-year-old was arrested at a unit in Valentine yesterday and charged with multiple offences - he's been refused bail to reappear in Toronto Local Court on October 30.

Police are urging parents to adhere to the following online safety tips to keep children safe:

• Be aware of how much time your child spends on the internet.

• Spend time talking to your child about the dangers associated with online conversations, particularly when communicating with someone that they have only ever met online.

• Spend time exploring the internet with your children and let them teach you about their favourite websites and applications.

• Keep computers or internet-enabled devices in a room the whole family can access, not in your child's bedroom; monitor internet access on those devices.

• Consider installing filtering and/or computer blocking software provided by your internet service provider.

• Ensure you are able to access your child's email and social media accounts and randomly check the contents.

• Check your phone bill for unusual outgoing calls and consider using 'caller ID' to identify incoming calls.

• Consult your telephone company for options designed to ensure privacy and security.

• Enquire with your child's school, public library, and places they frequent to find out what internet safety measures they have in place.
